The contract drawn up between sole – proprietorship Amira Ivancea and the Client is formalised when the order is accepted by sole – proprietorship Amira Ivancea, even if only partially. Said acceptance is considered tacitly granted if it is not otherwise notified through any means to the Client. By making an order according to the various methods, the Client declares to have read all the information provided to the latter during the purchase procedure and fully accepts the general conditions and payment conditions.

The sales contract between the Client and sole – proprietorship Amira Ivancea is formalised in Romania and regulated by Romanian Law. Any civil or criminal disputes arising in relation to the conclusion of this remote sales contract, in case the Client is a Consumer, shall be subject to the exclusive jurisdiction of the reference court of its city of residence while in all other cases, such disputes shall be subject to the jurisdiction of the Bucharest Tribunal.

It is strictly forbidden for the buyer to provide false information of third parties or fictitious names in the registration procedure required to set off the procedure for the buyer and execute this contract. Sole – proprietorship Amira Ivancea reserves the right to legally prosecute any breach or abuse in the best interest and protection of all consumers.

SHIPPING

The processing policy usually takes between 3-5 business days (excluding weekends) from payment confirmation. Once your order has been shipped, you will receive a confirmation email. The shipping number should arrive within the next 48 hours, and you will be able to easily check and control the status of your order with this.

Depending on the painting size and client’s country, we ship through multiple companies. We always choose the best option taking into account the price, safety and time-frame. We ship the orders with the DHL, TNT, Fan Courier or the National Post. Example: There are situations when a custom painting is rolled into a tube and can be safely shipped in a plastic tube with the National Post.

Orders in the EU:
Delivery typically takes 2-5 business days from the day the package is shipped (excluding holidays). There are no additional costs or taxes for shipping within the EU.

Orders outside of the EU:
Delivery typically takes 2-7 business days from the day the package is shipped (excluding holidays). The price of the product does not include any relevant VAT, GST or Import Duties. Such duty is entirely on the customer, that will have to pay the amount to the courier or the competent authorities. It is up to the customer to provide all the necessary information and/or pay the dues in order to proceed to clearance of goods. Otherwise, the goods will be sent back to our office.
Please keep in mind that delivery times are estimated only. The actual delivery time will have many contributing factors. If your order is time sensitive, please contact us before placing your order.

The goods always travel at the recipient’s risk. Sole – proprietorship Amira Ivancea will not be held liable for any issue or delay caused by the courier used for the shipment. While she does not take any responsibility for lost, damaged or stolen goods once your order has shipped, sole – proprietorship Amira Ivancea will investigate any specific situations.

All deliveries are posted to the address you provide, so please check your order dispatch email to ensure that the address is the right one. While sole – proprietorship Amira Ivancea accepts no responsibility for deliveries made
to incorrect or incomplete addresses, sole – proprietorship Amira Ivancea will investigate any specific situation.

In case of missed collection, after 2 delivery attempts by courier and lacking delivery information, the goods will return to the office in Romania. Shipping cost already paid will be withheld from your refund. In case of rejected/uncollected goods and/or customs duty unpaid, all shipping expenses – those borne by sole – proprietorship Amira Ivancea for return and initial cost for delivery – will be withheld from the refund. Goods must necessarily return to our office in Romania in order to start the refund procedure.

Upon receipt of the package, ensure that:

  • the package is intact, not damaged or wet and that it conforms to the standard characteristics of a package
  • the number of items specified in the invoice correspond to the number of items actually delivered.

Any disputes must be reported immediately to the carrier and proceed as follows:
state that the goods are subject to verification, namely that the package is accepted, but before signing the document you must write “Goods Received with Reservation” and state the reason for said reservation. In this case, once the package is opened, it must be checked for any damages; refuse the damaged goods whenever they cannot be accepted with reservation or in the event that a damage is visible without having to open the package.

A Client that receives a damaged good and signs with reservation, must notify it to sole – proprietorship Amira Ivancea within 3 days by email with delivery confirmation to the email address: dreams@amiras.art, specifying “DAMAGED GOODS” in the subject and including all the sales details in the message (name of sender, invoice number or order number, goods to be returned) and then follow the instructions provided.
A Client that receives a damaged good must notify it within 14 days by sending an email (with delivery confirmation) to dreams@amiras.art and must attach pictures proving the encountered defect.

Instructions to follow on how to return the goods will be provided later through the same email. After receiving goods that are defined as defective, sole – proprietorship Amira Ivancea will provide instructions on the replacement after carefully checking the material. Expenses to return the goods for replacement shall be payable by sole – proprietorship Amira Ivancea.

The defective packaging must be kept.
Materials purchased, if used, can neither be returned nor replaced.

Any shipment of materials must be authorised by sole – proprietorship Amira Ivancea.
If no disputes are reported, the product shall be considered delivered correctly.

RIGHT OF WITHDRAWAL

In compliance with Legislative Decree 206/05 (Consumer Code), a right of withdrawal may be exercised by the Client/Consumer (namely a natural person who does not make the purchase by specifying a reference to a VAT number in the order form) within 14 business days after receipt of the goods with full reimbursement of the paid amount.

In order to return the goods by exercising the withdrawal right, the Client must send an email to the following address (with delivery confirmation): dreams@amiras.art, within 14 days after receipt of the goods, specifying “WITHDRAWAL RIGHT REQUEST” in the email subject and including all the details of the sale in
the email message (name of sender, invoice number or order number, goods to be returned).

Once the email is received with which the Client informs of its intent to exercise the withdrawal right, Amira Ivancea shall verify the compliance of the above requirements and authorise the replacement of the goods by email.

The Client must ship the goods as follows:

  • the goods shall be shipped at the Client’s own expense;
  • the Client must make sure that the package is not damaged during transportation (the goods must be returned intact with all of its parts, including the internal and external packaging and the Client is fully responsible for the goods shipped back);
  • the Client must return the goods within 3 days after receipt of the authorisation to return the goods.

On receipt, sole – proprietorship Amira Ivancea shall check the integrity of the goods, including the original internal and external packaging. If the goods or part of the returned goods are damaged or missing or their internal or external packaging, Amira Ivancea will not proceed with the reimbursement and the goods will be
returned to the Client charging the latter for the new shipping costs.

Once the goods are received and the respective checks are completed, sole – proprietorship Amira Ivancea, shall proceed as follows:

  • Issue a new Credit Note for the amount equals to the value of the returned goods;
  • Reimburse the Credit Note within 30 days.

It shall be the Client’s responsibility to promptly provide all the necessary data in order to receive the due reimbursement.

The withdrawal right may not be exercised in the following cases:

  • If 14 days pass after the receipt date of the goods;
  • If customised or clearly customised packaged goods are purchased;
  • If the goods are rejected upon delivery (NOTE: in this case, the client will be reimbursed for the amount paid, minus storage and return fees)
  • The defective packaging must be kept.
